Marcdeturck and Co LTD with address Bulgaria, Sofia, Hristo Tenov str. 5-7, fl. 6., p.24 through its website blancodent.bg, provides the following service: through the technical resource of the Site, Users can conclude distance purchase and sale contracts within the meaning of the Consumer Protection Act with the Merchant by prepaying for the purchased goods or service or by paying for it at the time of delivery.
The Merchant reserves the right to refuse delivery of a confirmed order in case the goods are not available, in case of technical errors in order formation, as well as in case of incorrect behavior by the User, for which the User will be notified at the email address or phone number provided by them.
The prices of goods and services on the Site DO NOT include the delivery price. Delivery is carried out by courier Speedy or Econt.
When purchasing goods and services, the User explicitly declares that they are familiar with these General Terms of Use and undertakes to comply with them. Clicking the “PLACE ORDER” button constitutes a valid declaration within the meaning of the Electronic Document and Electronic Signature Act and binds the User to the terms of purchase and to these General Terms of Use.
The total value of the order is formed as the sum of the price of the ordered goods.
Goods with reduced prices are marked by placing the new price next to the old one, which is crossed out. If no term for the reduced price is specified, this price is valid until stock is exhausted, but not more than 1 month or 6 months.
Delivery
- The User is obliged to pay the price that was current at the time of concluding the contract.
- In case the goods are shipped outside the territory of the Republic of Bulgaria, the User must pay all additional fees related to this service.
- If the order is placed on a weekend or official holiday, the delivery period begins from the first following working day.
- Immediately after delivery, the goods should be carefully inspected by the User or a person authorized by them. The Merchant does not bear responsibility in case of deficiencies, damage and losses that occurred during transportation of the goods. In case of damage or violations to the external appearance of the goods arising during transport, a protocol for damaged shipment must be compiled in two identical copies, which is compiled at the moment of receiving the shipment and signed by the courier and the User.
- In case of incorrect or wrong address, contact person and/or phone number when submitting the order, the Merchant is not bound by any obligation to fulfill the order.
- In case of refusal to receive the goods, excluding the cases described below, the refusal is considered unjustified and the User owes payment for the delivery and return costs of the goods.
- In case the User is not found within the delivery period at the specified address or access and conditions for delivery of the goods are not provided within this period, the Merchant is released from their obligation to deliver the ordered goods. The User may confirm their desire to receive the goods even after the expiration of the delivery period in which they were not found at the address, by taking on all subsequent delivery costs. In this case, a new delivery period begins from the moment of confirmation.
Delivery terms from 1 till 14 days after placing an order.
Delivery in countries outside of Bulgaria are paid by the customer.The delivery outside of Bulgari might be 1 month.
In all cases, delays in the specified delivery times are possible, for which you will be promptly notified by Marcdeturck & Co Ltd.
Delivery Terms
Orders for goods from Marc De Turck & Co Ltd are accepted 24 hours a day, including on weekends and official holidays. Accepted orders are processed and shipped via courier within 1-14 working days, counted from the day you received notification that we will fulfill the order, or from the date of the order or received payment (for orders paid by bank transfer). The delivery period is extended accordingly by the number of non-working days for orders placed on Friday, Saturday, Sunday, and during official holidays.
The maximum delivery period for goods within the Republic of Bulgaria is 7 (seven) working days from the date of confirmation by the seller that the order will be fulfilled.
The delivery period for goods ordered under credit financing or installment conditions is from 24 hours to 4 working days and begins from the moment Marc De Turck & Co Ltd receives notification of credit approval for the candidate and receives the credited amount for the products/services.
Marc De Turck & Co Ltd reserves the right to unilaterally extend the delivery period by up to 7 working days without notifying the client, and to extend the periods by more than 7 working days with the prior consent of the latter.
In all cases, delays in the specified delivery times are possible, for which you will be promptly notified by Marc De Turck & Co Ltd.
Marc De Turck & Co Ltd bears no responsibility for delivery delays due to circumstances beyond its control, such as delays by the courier performing the delivery, prohibition by a state authority, extraordinary or force majeure circumstances, or force majeure under the Commercial Law.
Marc De Turck & Co Ltd has the right to unilaterally extend the delivery period or refuse delivery of goods or services in cases where the order is placed with payment via bank transfer, virtual POS/card, and the payment is not verified in the seller’s account.
Inspection for Defects upon Delivery
When delivering goods ordered from Marc De Turck & Co Ltd, the client is obligated to carefully inspect them personally or through a third party authorized by them to receive the goods.
Upon detecting external visible defects – possible damages, impacts, and other defects found during delivery, the client or third party should sign a damage report in the presence of the courier, describing the detected defects, and immediately, no later than 72 hours from delivery, notify Marc De Turck & Co Ltd of the findings.
When delivered goods clearly do not correspond to those ordered by the client and this can be established through ordinary inspection, the client has the right within 72 hours to request from Marc De Turck & Co Ltd a replacement with goods corresponding to the order.
Notification can be made in any way listed in Section II of these General Terms or through the contact form on the website.
Upon receiving notification under the previous paragraphs, Marc De Turck & Co Ltd will replace the damaged/non-corresponding goods within 5 working days, unless there is no available stock of the same type – in which case new conditions will be negotiated with the client.
Acceptance of the Package
When accepting delivery by the client or third party without remarks, any subsequent claims for external visible defects are unfounded. If a damage report is not prepared and signed upon receipt and Marc De Turck & Co Ltd is not notified within 72 hours, the client loses their right to make a claim.
This does not release Marc De Turck & Co Ltd from the obligation to offer goods corresponding to the contract, as well as to provide legal warranty.
In case of refusal to accept delivery, the consumer owes all delivery costs.
When handing over goods (except in cases of cash-on-delivery), the client or authorized third party must sign the accompanying documents.
Marc De Turck & Co Ltd provides appropriate packaging for goods. In case of missing product, document, or component – the client should contact us and we will assist in resolving the issue.
Non-acceptance of Order and Unjustified Refusal
If the client or authorized person cannot be found or access for delivery is not provided, Marc De Turck & Co Ltd considers this an unjustified refusal.
Marc De Turck & Co Ltd has the right to send notification for unclaimed package and claim costs. Electronic notification is considered received from the day of sending.
The client may again confirm their desire to receive the goods by bearing the new costs. In case of lack of availability, delivery will not be performed.
The client owes reimbursement of delivery and return costs within 7 days, unless otherwise specified.
RIGHT OF WITHDRAWAL AND PRODUCT EXCHANGE (for consumers only)
Within 14 days from concluding the contract (service) or from receiving the goods (for orders), the consumer has the right to withdraw without reason, owing only the return costs and initial delivery. If the product/packaging is damaged, Marc De Turck & Co Ltd has the right to withhold an amount for the reduced value.
Upon withdrawal, all additional contracts are automatically terminated, except those provided for in the Consumer Credit Act.
The right of withdrawal does not apply if: the deadline has expired; the goods are not returned on time; components are missing; there is no proof of purchase from Marc De Turck & Co Ltd; the service has started immediately at the consumer’s request; in case of abuse (used, damaged goods); for cash-on-delivery – in this case the supplier has the right to refuse acceptance.
For orders with multiple deliveries, the period begins from the last received goods.
For batches – from the date of the last batch.
For subscriptions – from receiving the first delivery.
The consumer has no right of withdrawal in cases of: fully performed services with express consent; price fluctuations in financial markets; custom-made goods; goods with short shelf life or that spoil quickly; opened hygiene products; individually manufactured products; used or damaged products; orders placed outside the online platform.
The consumer may request an exchange within 14 days if the product does not meet expectations according to its intended purpose.
Upon approval, Marc De Turck & Co Ltd replaces the product within 14 days. If the same is not available, an alternative will be offered. In case of disagreement, the consumer will receive the amount back.
